Determining the composition of Pillar 2 requirements

Where necessary, and having regard to the institution’s specific circumstances, competent authorities may decide to require the institution to cover P2R with a higher quality of capital than that referred to in Article 104a(4) of Directive 2013/36/EU⁽⁵¹⁾. This decision should be clearly justified, highlighting the specific circumstances that led to it. In their justifications competent authorities should refer to elements such as:

the specific nature of the institution, its shareholding structure and, where relevant, the group structure, potentially affecting the possibility to raise capital;

the specific nature of risks faced by the institution, potentially leading to a particularly rapid depletion of CET1 capital.
